TERMS & CONDITIONS
1. Agreement
This Agreement governs your access to, browsing and use of www.rivalspot.com (the "Website") and the services offered thereon (the "Services"), including all gaming activities and the downloading, uploading, posting or submission of, without limitation, any applications, software, files, texts, graphics and communications, as applicable.
It is Rivalspot Sports Entertainment Inc.'s ("Rivalspot") goal to provide our users – that's you -- with a top-notch, dare we say "epic" gaming experience. Therefore, if you have any questions or comments (even ones you may think are stupid) about these Terms and Conditions, please contact us at info@rivalspot.com.
2. Eligibility
i. Age and location
You must be a natural person and have attained the age of majority in your jurisdiction. For citizens and residents of the United States of America, use of the Services is prohibited in the following states: Arizona, Arkansas, Delaware, Florida, Illinois, Iowa, Louisiana, Maryland, Montana, Tennessee and Vermont (sorry, but them's the rules -- if you're stuck in those states where the Services are prohibited, you have our sympathies). Access to the Website and the use of the Services in any of the abovementioned states, and in any other location wherever in which access to the Website and/or use of the Services is prohibited by law, shall constitute a contravention of these Terms and Conditions and a violation of law in said jurisdictions. We reserve the right, at any time, to (i) request from you evidence of age and (ii) monitor that your location of access to, and use of, the Website and Services, as applicable, is lawful.
You hereby acknowledge and agree that Rivalspot shall not be held liable in the event your use of the Services is prohibited by law, and Rivalspot makes no representations or warranties as to your rights in connection with the use of the Services, nor shall any person affiliated, or claiming affiliation therewith, have authority to make any such representations or warranties. Or in layman's terms, you break the law, you're on your own, boy.
ii. Non-arm's length party
In addition to the restrictions stated in section 2i), the following individuals shall not be eligible to win and collect any prizes in connection with the Services: Rivalspot's directors, officers, employees, agents, representatives, and any spouse, child, sibling of, or any person permanently residing in the household of, any of the foregoing, as well as the directors, officers, employees, agents and representatives of Rivalspot's parent company, its subsidiaries and affiliates, as well as any spouse, child, sibling and any person permanently residing in the household of any of the foregoing. So, if you're part of the Rivalspot team (or just sponging off one of the members by living under the same roof), that means you're not eligible to win. Hey, that's why it's called "Non-Arm's Length."
3. User Account
i. Personal information and log-in credentials
Use of the Services requires the creation of a user account (though you probably figured that out – you can't play without an account). A user may only have one account. The creation of a user account is free and requires a user's name, email address, as well as any other personal information which Rivalspot may require pursuant to its registration form. Each user account shall be accessible through the use of a combination of a unique username and alphanumeric password ("Log-in Credentials") – you know, like every other site you have an account with. The username will serve as a user's "alter ego" when using the Services. Rivalspot reserves the right to change, reject or cancel any username that it deems objectionable or offensive in any way. So try to keep it clean, guys, this isn't a frat house. Well it sort of is, you know what we mean by "keeping it clean."
ii. Secrecy and confidentiality
User shall keep your Log-In Credentials secret and confidential and shall do all things necessary to maintain such secrecy and confidentiality (as in, protect your password!) User shall not allow anyone to access or use his/her user account for any purpose. User acknowledges that he/she is solely responsible for any use of the Services under your Log-in Credentials and shall be responsible for any and all obligations arising in connection therewith. Rivalspot shall neither incur any liability nor issue any indemnity in relation to any unauthorized use of the Services under user's Log-In Credentials. Or, to put it another way, if you give someone the keys to your house, you've got to clean up the mess, not us. Got it?
iii. Accuracy
User represents and warrants that all information supplied to Rivalspot shall be complete and accurate, and agree to maintain said information correct, accurate and complete. In the event that user provides any information that is inaccurate, not current or incomplete, or if Rivalspot shall have reasonable grounds to believe that such information is inaccurate, not current or incomplete, Rivalspot may, at its discretion, suspend or terminate user's account and void any or all prizes or winnings earned on or prior to the date of such suspension or termination. So, false info means getting kicked out of the party. And we wouldn't want that.
iV. Assignability
User shall not sell, assign or transfer your account.
iV. Security breach
In the event of a potential breach in the security of a user's Log-In Credentials, said user shall immediately notify Rivalspot through the Contact page on www.rivalspot.com. Certain documentation may be required in order to confirm user's identity. In the event user fails to provide such documentation, Rivalspot may suspend access to user's account and withhold all winnings owing thereto until such time as user's identity has been confirmed. In addition to the foregoing, user shall be liable for any and all obligations arising from any transaction conducted under user's Log-In Credentials. So if Rivalspot asks for certain documentation to fix the mess, better get on top of that right away – otherwise, no winnings, and no gaming.
4. Intellectual property
i. Intellectual property rights
Rivalspot Sports Entertainment Inc., Rivalspot, www.rivalspot.com and other Rivalspot marks, graphics, logos, scripts and sounds are trademarks and copyrights, as applicable, of Rivalspot and/or its parent company, subsidiaries and affiliates. All material and information used on the Website, including, without limitation, all software, graphics, photographs, images, animations, videos, audio, text and logos are owned by Rivalspot, its parent company, subsidiaries, affiliates, licensors or third parties and are protected by copyright, trademark, patent or other intellectual property rights. User is hereby licensed to use the Services pursuant to these Terms and Conditions. User shall not have any right or any license to use any such trademarks, copyrights, logos, service marks, patents or other intellectual property rights for any purpose other than for the lawful use of the Services, and user shall not reproduce, modify, publish, assign, sell, reverse engineer or in any way exploit, as applicable, any of the foregoing material or information without Rivalspot's express written consent. In other words, don't bogart our intellectual property.
ii. User submissions
All user submissions to, and postings on, the Website, whether to Rivalspot or other users, including, without limitation, all comments, feedback, suggestions, ideas, photographs, drawings and other submissions and postings, shall be the sole property of Rivalspot without any compensation to user, unless otherwise prohibited by law. So, you know, just a friendly heads up before you start posting your manuscript or other personal works of great art on your Rivalspot profile page.
iii. Personal information
Please refer to our Privacy Policy which is incorporated herein by reference. Notwithstanding anything contained therein, user hereby agrees that Rivalspot may use user's username, biographical information, picture, voice, likeness, gaming records and all information regarding any accepted prizes or winnings for promotional purposes, without any further compensation thereto. No compensation, just the joy of knowing you're the poster child for hardcore gaming at Rivalspot. All in all, a fair trade.
5. Head-to-head challenges and tournaments
The Services allow users to compete and track head-to-head challenges and multi-player tournaments solely in connection with games of skill. Each user is solely responsible for managing their play in any such challenges or tournaments.
i. Head-to-head challenges
a) Posting/Acceptance of Head-to Head Challenge
User may post an "open" head-to-head challenge (which is open to any user) or a "closed" head-to-head challenge (which is solely open to a specific user). All challenges are between Rivalspot users; the Website shall not participate in any game play. The Website shall act as trustee in connection with all wagers. Each posted challenge shall state the following: (1) the game which is the subject of the challenge (ii) the date and time on/at which such challenge shall occur and (iii) the wager. Challenges are open for acceptance immediately upon the posting thereof.
Rivalspot may, at its sole discretion, close the Website or determine when challenges/tournaments may be posted. You know the deal – you set up the challenges, Rivalspot serves as the trusted broker.
b) Binding Nature
The posting or acceptance of a challenge, as the case may be, creates a binding obligation on the "challenger" and "challengee," as applicable, to participate in said challenge. Notwithstanding the foregoing, a user may withdraw a posted challenge in the event said challenge has not been accepted, or cancel an accepted challenge via a posting to the other user at least thirty (30) minutes prior to the commencement of the challenge. In the event either user does not cancel a challenge as aforementioned and fails to participate in said challenge, said user will be deemed to have lost by default and will forego any wager made in connection therewith. In the event both users fail to participate in an accepted challenge that has not been duly cancelled, Rivalspot shall reimburse to each such user the wager made in connection therewith, minus the service fee (please refer to section 5iii). Furthermore, users may agree to modify the terms of the challenge. Rivalspot shall be informed of any such changes by notice. Again, layman's terms: if you can't make your challenge, it's up to you to cancel – or else you lose by default. Pretty basic stuff.
c) Cancellation by Rivalspot
Rivalspot reserves the right to withdraw or cancel, either temporarily or permanently, any posted and/or accepted challenge in the event that such challenge, the information provided in connection therewith or any user having posted or accepted said challenge is in breach of these Terms and Conditions. Rivalspot shall not be liable for any incorrect entries or information provided by a user in connection with a challenge.
ii. Tournaments
a) Terms
From time to time, Rivalspot may organize multi-player tournaments. All tournament games are between Rivalspot users; the Website shall not participate in any game play. The Website shall act as trustee in connection with the prize money relating thereto. Tournament rules and entry fees shall be posted on the Website. A user cannot withdraw from a tournament once he has joined that tournament. In the event a user fails to participate in a tournament (a no-show), said user shall forfeit the game, the entry fee and the service fee. Just like the head-to-head tournaments, Rivalspot is the honest broker. But again, once you join these multi-player tournaments, you can't bail out. Otherwise, you forfeit the game, your entry fee, and your service fee (not to mention your rep.)
b) Prize Money
The prize money in connection with a tournament shall be posted on the Website prior to the commencement of said tournament. The prize money shall consist of the aggregate of all entry fees received up to the time of commencement minus a service fee (please refer to section 5iii). We do not provide any odds of success, as such odds are dependent on (i) the number of users participating therein and (ii) the skill level of such users. Rivalspot shall not in any way be liable for any lost or potential winnings resulting from any reason whatsoever.
iii. Service fee
Upon the posting/acceptance of a challenge or the entry into a tournament, you irrevocably authorize Rivalspot to deduct 15% of the wager/entry fee as a service fee from the applicable account(s).If sufficient funds are not available, then you may not take part in the challenge or tournament, as the case may be. Or, as they say, you wanna play, you gotta pay – the 15% service fee, that is.
iV. Results for head-to-head challenges and tournaments
Rivalspot's proprietary technology enables it to receive all results of each head-to-head challenge and all games played within a tournament directly from a user's agreed public domain page. Rivalspot independently verifies all results to the usage of a proprietary software and displays the results on the site. All results posted by Rivalspot shall be final.
V. Withdrawal requests
Users may request a withdrawal of funds from their available cash account balance in their Account at any time. However, any account holders with pending deposits must wait until those funds clear before you can request a withdrawal. Withdrawing privileges will also be revoked for security purposes when account fraud is suspected. In other words, we're keeping a close eye to prevent any type of illegal activity – and at the top of our list is account fraud. Try and pull that one, and you won't be able to withdraw.
Withdrawal methods are either via Rivalspot MasterCard, PayPal or Check. Here's the deal with the Rivalspot MasterCard. There's a one-time activation fee to be paid to MasterCard – $9.95 (USD) for U.S. residents, and $19.95 (USD) to all residents outside the U.S. You can expedite processing to your Rivalspot MasterCard for an additional fee -- $2.00 (USD) for 2 business days, or $5.00 (USD) for immediate (within 2 hours). Account maintenance fees are as follows: 0-4 transactions per month: $3.00 (USD)/month. 5+ transactions per month: $1.00 (USD)/month. So, yeah, all in all, a pretty great deal. Also, monthly account maintenance fee is deducted from available balance only. Fees will never drive an account negative and are not incremental.
The minimum withdrawal is $20.00 (USD) or the player's entire balance (if less than $20.00 USD). All withdrawals are subject to a withdrawal fee, except for those made by players whose balance is less than $3.00 (USD). However, if the desired amount is under $3.00 (USD), the withdrawal cannot be done. A withdrawal fee ("
Withdrawal Fee") of $2.00 (USD) applies to U.S. residents, and $3.00 (USD) applies to all residents outside the U.S. Also, the account must be valid. And your withdrawal request cannot include unearned bonus dollars, and no disputes are opened against you.In order to withdraw funds, you must meet all of the above conditions and all withdrawal requests are subject to approval by Rivalspot. Sorry, but that one is not up for debate.
When you request a withdrawal of funds, Rivalspot will process your request based on whichever method you decide you want – Rivalspot MasterCard, PayPal or Check. However, Checks are only available for residents of North America – if you live outside North America, well, sorry, but it's not an option for you. Hey, that's how we roll.
Most withdrawal requests through Rivalspot MasterCard, PayPal, or Credit Card should be in your account within 5-10 business days. If you don't receive your withdrawal within 10 business days, please contact customer support at

Checks will be mailed within 10 business days. Rivalspot.com uses Letter Post to send out all hard copy checks. We also offer Registered Mail (5-10 days) for an additional fee of $15.00 (USD), Xpresspost (2-3 days) for an additional fee of $25.00 (USD) and Priority Shipping (Next Day) for an additional fee of $45.00 (USD).
Users may also go to their Transaction History on the Rivalspot website to view the status of pending checks. All checks will be mailed to the current address reflected on the User's Account. If a check is returned to Rivalspot (due to an incorrect address or any other reason) the User's account will be suspended.
Upon receipt of your withdrawal request, said amount will be locked, and will not be playable. However, if your withdrawal request is denied, you will receive an email notification identifying the reason, and the requested amount will be credited back to your account.
Rivalspot's withdrawal process has been implemented to minimize customer fees, as well as to add another layer of security to protect you, Rivalspot's valued customers. In our continuing mission to stamp out fraudulent behavior and account hijacking, Rivalspot reserves the right to require the Account User or credit card company (if applicable) to submit verification of identification, in order to determine the validity of a withdrawal request and the User's identity. Hey, it's just like making any other withdrawal – they require proof at the banks, too. Withdrawal payments won't be made until such verification is received; if Rivalspot hasn't received the verification within 10 days, the withdrawal request will be cancelled and the User account in question will be suspended.
Your winnings are awarded to you in their entirety, and all federal, state, and local taxes due in connection with any winnings awarded to you are your sole liability. This is a big one, guys – don't forget to pay your taxes on your winnings. If you don't, it will come back to bite you in the ass.
* Initial registration Bonus -- withdrawal restrictions apply: (1) limit one bonus per household; (2) limit one bonus per network ID/Gamertag; (3) must participate in a minimum of three tournaments and/or head-to-head matches totaling at least the bonus amount; (4) bonus not withdrawable for 45 days; (5) general site terms and conditions apply.
Vi. Cash games and Free games
Users who deposit money into their accounts may choose to participate in Free Games or Cash Games, unlike Users without deposits, who may only play Free Games. No money means no playing for money – but we're sure you figured that out already.
Vii. Deposits
To participate in a Cash Game, you will be required, from time to time, to pay funds into your account by any of the methods permitted by the site. Said funds will be deposited into your account upon actual receipt of funds by Rivalspot and/or its agents. Minimum and maximum limits may be applied to the payments into your account, depending upon your history with the site, your method of deposit, and other factors as determined solely by Rivalspot. Remember, Rivalspot is not a bank and funds are not insured by any government agency. No interest is payable on amounts on deposit in your account. All payments into your account must be from a payment source on which you are the named account holder.
Rivalspot may impose dollar amount limitations on the payment transactions you use to fund your activities on the site. Rivalspot may, but is under no obligation to, impose limits on the net dollar amount you may lose on the site in any calendar month; should your losses reach the designated limit, your ability to play Cash Games offered on the site will be restricted until the beginning of the next calendar month (although you will still be eligible to participate in Free Games during this period). Rivalspot reserves the right to impose or change these dollar amount limitations at any time. Rivalspot also reserves the right to require you to confirm or validate any or all deposits previously made to your account. You acknowledge that in the case of a dispute, your validation may be used by Rivalspot as evidence of your deposits.
Viii. Cheating challenge and tournament play
Users shall not contravene the rules set forth and agreed upon in connection with a challenge or tournament. Any such contravention shall constitute cheating. Users are encouraged to immediately report any case of cheating along with evidence of any such violation. Rivalspot considers various types/forms of evidence when investigating a case of cheating. We take this very seriously, so we can't say this enough: if you think you're the victim of cheating, please immediately report it to us – don't worry, we won't brand you as a "tattle-tale."
6. Prohibited acts
The following acts are strictly prohibited:
i. The sale, assignment or transfer of this Agreement, a user account or the use of your user account by any other person with your knowledge and/or consent;
ii. The opening and/or use of multiple user accounts;
iii. The submission of any false or misleading information;
iV. Intentionally poor play in order to achieve a broader competitive advantage (i.e. "sandbagging");
V. The use of, without limitation, external player assistance programs, automatic players (bots), memory readers or anything that diminishes the fairness of play or the skill component of the games;
Vi. Collusion with other players;
Vii. The unlawful access to, or interference with, Rivalspot's systems and/or communications;
Viii. Causing a breach of security with respect to the Website or any user account;
iX. The use or posting of any of the following in connection with your use of the Website and the Services: language that is abusive, hateful, profane, obscene, lewd, slanderous, pornographic, insulting, threatening, harassing, insulting or indecent; the impersonation of other users; anything of an advertising or promotional nature; hyperlinks; matter that infringes any intellectual property right of another; viruses or computer programs that could affect the function of external computers; and spam (including, without limitation, surveys, solicitations, electronic mail from sources that do not have any relationship with either Rivalspot or the user, messages regarding subject matter that is "off topic," cross-posted to unrelated newsgroups, or posted in excessive volume and solicitations posted to chat rooms, groups or individuals via Internet relay chat or "instant messaging" system);
X. Money laundering;
Xi. Committing or attempting to commit fraud; and
Xii. Any activity which Rivalspot may deem, from time to time, as being contrary to the purpose of the Website and Services.
Pretty obvious here – don't do anything stupid, and you won't get busted.
7. Suspension/termination
i. Suspension/termination by Rivalspot
a) Breach of these Terms and Conditions
In the event of any breach of these Terms and Conditions, Rivalspot may, in its sole discretion, either suspend your account or your use of various aspects of the Services or terminate a user's account, withhold said user's account balance and void any and all winnings and/or prizes won thereby prior to the date of suspension or termination, as applicable. In other words, violate the rules, and you could lose more than just your user account.
b) Charge Back and Bankruptcy or Insolvency
Rivalspot may, in its sole discretion, either suspend or terminate a user's account in the event said user has "charged back'" or denied any of the purchases or deposits made thereby, or in the event said user is declared bankrupt or insolvent or is subject to analogous proceedings anywhere in the world.
c) Inactive Account
Rivalspot may automatically suspend an account to Dormant Status without notice in the event an account remains inactive (no log-ins to the Website, no transactions, no wagers) for a period of sixty (60) consecutive days. If a user's account has been put into Dormant Status as a result of said inactivity, a monthly administration fee of $3.00 (USD) will be charged to a user's account for each 30 day period in which the account remains Dormant following the date of suspension. The user may re-activate his/her Dormant Account by contacting Rivalspot's customer support, and paying the $10.00 (USD) re-activation fee.
d) Failure to Enforce
Rivalspot's failure to enforce any provision of these Terms and Conditions shall in no way be construed as a waiver of such provisions and shall not in any way affect its right to enforce said provision thereafter. Any waiver by the company with respect to any provision contained herein shall not constitute a waiver of any future obligation. Pay close attention to this one – Rivalspot's failure to enforce does not let you off the hook in any way, shape or form.
ii. Suspension/termination by user
A user may suspend or terminate his/her account at any time upon written notice to the Contact page at www.rivalspot.com. Until such time as the termination request is processed and complete, you acknowledge and agree that you shall remain liable for all activity on said account. All funds remaining in your account shall be transferred back to you, minus the service fees. In the event amounts are owed on your account, you shall receive an electronic notice of same, which balance must be paid within ten (10) days following the date of notice. Please refer to our Responsible Gaming memorandum. So if you do decide to terminate your account (why in hell anyone would want to do that, we'll never know!) you have to let us know in writing.
8. Third party payment processor
In order to use the Services, users will be required to send money to, and may be required to receive money from, Rivalspot. User irrevocably authorizes Rivalspot to instruct such third party payment processors (individually an "ESP") to handle cash account deposits and withdrawals from his/her account, and user irrevocably agrees that Rivalspot may give such instructions on user's behalf in accordance with his/her requests as submitted through the Website, or via instructions to customer care. User agrees to be bound by the terms and conditions of each applicable ESP, and in the event of a conflict between these Terms and Conditions and the ESP's terms and conditions, then these Terms and Conditions shall prevail. User agrees that Rivalspot shall not be liable for any loss caused by any unauthorized use of a user's credit card or other method of payment by a third party in connection with user's use of the Website, except as a result of the gross negligence of Rivalspot or its employees.
9. Representations and warranties
User represents, warrants, covenants, agrees and acknowledges that: there is a risk of losing money when using the Services and that Rivalspot has no responsibility to user for any such loss; user's use of the Services is at user's sole option, discretion and risk; all information provided by user is correct, accurate and up to date; and user's use of the Services shall only be for lawful purpose pursuant to the Terms and Conditions and the terms and conditions of any ESP. Rivalspot's control of the information provided by you shall be subject to our Privacy Policy. Hey, that first part should be pretty obvious – but on the other hand, no risk, no reward. Just gotta drill the point home – Rivalspot is not responsible for your losses.
10. Taxes
User shall be solely responsible for any applicable taxes which may be payable on prizes and/or winnings earned pursuant to the use of the Services under user's account and Log-In Credentials. With respect to U.S. players, in the event that your total winnings (including prizes and winnings) in any given year are equal to or greater than $600, Rivalspot shall provide you with an IRS Form 1099, or other appropriate form, as required by Internal Revenue Service regulations; and you are solely responsible for the telecommunications networks and Internet access services required for you to access and use the Service and We shall have no liability whatsoever for any deficiencies therein. Again, this one's pretty major – if you're a U.S. resident, you will be required to report your winnings to the IRS, provided they're $600 or more. Don't even think of dodging this one. Seriously. Trying to beat your buds at FIFA = good. Trying to beat the IRS = don't.
11. Intellectual property
i. Disclaimer of warranty
Rivalspot disclaims any and all warranties, expressed or implied, in connection with the goods and Service which are provided to user "AS IS" and "AS AVAILABLE" and Rivalspot does not provide any representation or warranty whatsoever regarding the quality, fitness for purpose, completeness or accuracy of said goods and Services. Rivalspot does not in any way warrant that the Services will be uninterrupted, timely or error-free, that defects will be corrected or that the Services will be free from viruses or bugs. Rivalspot reserves the rights to suspend, discontinue, modify, remove or add to the Services and the Website in its sole discretion with immediate effect and without notice, and Rivalspot shall not be liable for any loss suffered as a consequence of any decision made by Rivalspot in this regard. Rivalspot shall not be liable in any way for any malfunction whatsoever, whether in relation to the Services, the user's gaming platform or any problems or failure with respect to user's network connections. Or, put more bluntly, the Internet, as much as we may love it, is not always reliable. Ditto for your gaming consoles. We at Rivalspot aren't liable for any of those glitches, or subsequent losses you may incur.
ii. Disclaimer of liability
User acknowledges that the use of the Website and the Services is at said user's sole risk. Notwithstanding anything to the contrary contained herein, or that has been posted or made available through the Website, whether by Rivalspot, a user or a third party, Rivalspot, its directors, officers, employees, representatives, agents, licensors and any third party supplier of goods and services thereto shall in no way be liable for any injury, loss, or direct, indirect, consequential, special, exemplary or punitive damages resulting from a user's access to the Website, use of the Services (or any access to the Website or use of the Services under a user's Log-In Credentials), failure of performance, whether due to force majeure, theft, destruction or the unauthorized access to Rivalspot's programs, servers, documents (whether or not Rivalspot has been advised of same), as well as the downloading of any information, software or any other material from the Website, including, without limiting the generality of the foregoing and for example purposes, damage to a user's gaming platform or computer or any other device used in connection with the Website and/or Services. Yeah, just in case you need another reminder – we at Rivalspot are not liable for your injuries, losses, or damages from using the Website.
iii. Medical warning
It should be noted that some users may experience epileptic seizures upon exposure to certain light patterns or backgrounds on a television screen. Certain conditions may induce previously undetected epileptic symptoms even in users who have no history of prior seizures or epilepsy. If you, or anyone in your family, is affected by an epileptic condition, we strongly encourage you to consult with your physician prior to using the Services. Immediately discontinue use of the Services and consult your physician if you experience any of the following symptoms during use thereof: dizziness, altered vision, eye or muscle twitches, loss of awareness, disorientation, any involuntary movement, or convulsions.
12. Indemnity
User agrees that the Services be used in accordance with these Terms and Conditions. User agrees to defend, indemnify and hold harmless Rivalspot, its parent company, subsidiaries and affiliates and each of their directors, officers, employees, agents and representatives from and against all liabilities, actions, claims and expenses, including legal fees arising out of, or relating to, any use of the Website (in any manner) under your Log-In Credentials, any breach of these Terms and Conditions and/or sports betting regulations, as well as any breach of any third party rights.
13. Notices/complaints/claims/disputes
All notices, complaints and claims shall be submitted to the Contact page at www.rivalspot.com as soon as is reasonably practicable following the date of the original event to which said complaint or claim refers. All replies by Rivalspot will be sent to the email address on record. Thus, user shall ensure that his/her contact information is correct, accurate and up to date. Rivalspot shall not be liable in any way for any delays, or any damages resulting from, your failure to ensure the correctness, accuracy and currency of your contact information. In other words, make your complaints as soon as possible, with all the correct contact info. Make sure that contact info is accurate… Rivalspot can't be held liable if you screw that up.
14. Choice of law/disputes
This Agreement shall be governed exclusively by the laws of the Province of Ontario, Canada, regardless of any conflict of law principles, and you hereby agree to the exclusive jurisdiction of the courts of the Province of Ontario, Canada as regards to all legal action in connection with the Website and the Services. All disputes that cannot be resolved between the parties shall be resolved individually, without resort to any form of class action.
15. Severability
If any provision of this Agreement is held by a court of competent jurisdiction to be invalid, void or unenforceable for whatever reason, the remaining provisions not so declared shall nevertheless continue in full force and effect without being impaired in any manner whatsoever..
16. Entire agreement -- Amendments
This Agreement and the other documents referred to herein constitute the entire, final and complete agreement and understanding of the parties hereto and relating to the subject matter hereof. Rivalspot reserves the right to amend this Agreement or any part thereof. All amendments shall have immediate effect upon the posting and notification thereof on the Website. Your continued use of the Website and the Services shall be deemed an acceptance of any such amendments. Got it? Any amendments to this Agreement take place immediately; continued usage of the Website means you're down with that, along with any new amendments.
17. Rules for dispute -- challenge
It's bound to happen – you had a scheduled match against your rival, he wins the game – but due to one of many circumstances, you wish to challenge the results. Well, the good news is, you have up to 48 hours after your challenge ends to dispute the results.
Once a dispute has been opened, Rivalspot's team of experts will individually review your claim, and come up with a solution that you guys can all live with. Let's say player A and player B played a match. A gets the win, but B opens up a dispute. Once our team reviews the case, a winner will be declared. If the game results stand, then A will be determined to be the winner, and no action will be taken. But if it is decided that B is the winner, B's account will be credited, with the money taken back from A's account.

18. Rules for dispute – tournament
Like we said, sometimes, the situation calls for a dispute to be opened up. But you should know that Tournaments have a different procedure than your standard Challenge. Let's just say that a Tournament Round is supposed to start – Player A is present, player B is absent. If, in a specified about of time – fifteen (15) minutes after the round begins, B is still absent, then A has a thirty (30) minute window to open up a dispute. If, after that thirty (30) minute window – forty-five (45) minutes after the scheduled start of the round, B does not respond to the dispute, A is declared the winner and moves on to the next round.
However, if B is absent and opens a dispute during said window instead, and A does not respond, B will be declared winner at the round's end and moves on to the next round. And if B is absent but nobody opens a dispute, then both players are disqualified. So stay on top of it, boy!
